1. Acceptance of Terms

By accessing and using PsychPal ("the Service"), operated by Jules Poiron, located at 313 3rd Street, Box 291, Somerset, MB R0G 2L0, Canada, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use the Service. You must be at least16 years of age to use this Service.

2. Description of Service

PsychPal is an AI-powered mental wellness companion that provides:

  • Evidence-based emotional support and coping strategies
  • Daily emotional check-ins and mood tracking
  • Personalized therapeutic exercises based on CBT, DBT, and ACT principles
  • Appointment and notes management
  • Support person messaging features

3. Important Limitations

PsychPal is NOT a substitute for professional mental health care.

  • We cannot diagnose mental health conditions
  • We cannot prescribe medications or treatments
  • We cannot provide crisis intervention or emergency services
  • We are not a replacement for therapy, psychiatry, or medical care

4. Safety & Acceptable Use

PsychPal uses AI to recognize language that may indicate a credible threat of harm to yourself or to others. The classifier distinguishes between three severity levels:

  • Level 1 — Concern: ambient ideation, rumination, or revenge fantasies without a specific plan or timeline. The AI continues the conversation with a gentle de-escalation response. A record is logged for safety review; no lock is applied and no one is notified.
  • Level 2 — Specific: a credible threat of harm to a specific, identifiable person. The AI pauses for 15 minutes and our safety team is notified by SMS after a 90-second user opt-out window. Emergency contacts are not notified at this tier (a contact may be the person at risk).
  • Level 3 — Mass: mass-violence ideation. The AI pauses for 20 minutes, our safety team is notified, and emergency contacts you have added to your profile are also notified by SMS after the 90-second opt-out window.

When an incident is flagged, a member of our internal safety team — limited to individuals on a server-side allow-list and bound by confidentiality — may review a trigger snippet (up to 500 characters) and the AI's response. Full conversation history is not exposed at this layer; broader access is gated behind a separate credential and audited independently. Every review action writes to an immutable audit log.

PsychPal does not autonomously contact 911 or any emergency service on your behalf.If you are in immediate danger, please call 911 (North America), 988 (Suicide & Crisis Lifeline), or 1-833-456-4566 (Crisis Services Canada).

User obligations. You agree not to use PsychPal to plan, rehearse, solicit, or otherwise prepare acts of harm to yourself or to others. Doing so may result in immediate suspension of your account and, where law requires, disclosure to appropriate authorities. Please see our Privacy Policy for what data a safety event captures and how long it is retained.

5. Subscription Terms

5.1 Free Trial

New users receive a 7-day free trial upon registration. No payment information is required during the trial. After the trial period ends, access to the Service will require an active paid subscription.

5.2 Subscription Plans

We offer the following subscription options:

  • Monthly Plan: $5.99 USD per month
  • Yearly Plan: $60.00 USD per year (equivalent to $5.00/month)

5.3 Billing and Renewal

  • Subscriptions automatically renew at the end of each billing period
  • You will be charged at the beginning of each billing cycle
  • Prices are subject to change with 30 days notice
  • Payment is processed securely through Stripe

5.4 Cancellation

  • You may cancel your subscription at any time through your Stripe customer portal
  • Cancellations take effect at the end of the current billing period
  • You will retain access until the end of your paid period
  • No refunds for partial billing periods unless required by law

6. Refund Policy

6.1 7-Day Money-Back Guarantee

If you are not satisfied with the Service, you may request a full refund within 7 days of your first paid subscription charge. Contact us at psychpal@outlook.com with your refund request.

6.2 Other Refunds

After the initial 7-day period, subscriptions are non-refundable except:

  • Technical issues preventing use of the Service (we will attempt to resolve first)
  • Duplicate or erroneous charges
  • As required by applicable law

6.3 Processing Time

Approved refunds will be processed within 5-10 business days and returned to your original payment method.

7. User Responsibilities

You agree to:

  • Provide accurate registration and payment information
  • Maintain the confidentiality of your account credentials
  • Use the Service in compliance with all applicable laws
  • Not share your account with others
  • Not use the Service for any illegal or unauthorized purpose

8. Privacy, Data, and Health Information

Your use of the Service is also governed by our Privacy Policy. We take your privacy seriously and handle your personal health information in accordance with applicable Canadian privacy legislation, including the Personal Health Information Protection Act (PHIPA) and the Personal Information Protection and Electronic Documents Act (PIPEDA). All data is stored in Canada.

9. Intellectual Property

All content, features, and functionality of the Service are owned by PsychPal and are protected by international copyright, trademark, and other intellectual property laws.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PSYCH PAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Termination

We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Manitoba, Canada.
